POPI Act Privacy Policy

Foster-Melliar Pty Ltd is strongly committed to protecting your privacy and complying with your choices. Both personal and non-personal information collected is safeguarded according to the highest privacy and data protection standards adopted worldwide. We have always had a robust and effective data protection program in place which complies with existing law and abides by generally accepted data protection principles. However, we recognise our obligations in updating and expanding this program to meet the demands of the Protection of Personal Information Act (“POPIA”) and the General Data Protection Regulations (“GDPR”), to the extent that the GDPR may be applicable.

This Privacy Policy describes our policies and procedures on the collection, use and disclosure of Your Personal information when You use the Foster-Melliar Service and tells You about Your privacy rights and how POPIA protects You in relation to the Processing of your Personal Information.

    • Country refers to: South Africa.

    • Processing: means any operation or activity or any set of operations, whether or not by automatic means, concerning Personal Information, as defined in POPIA.
    • Service: refers to the services listed on the company’s website or the online portal administered by the Company in respect of its E-Learning Courses.
    • Service Provider: means any natural or legal person who processes the Personal Information on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. Such Service providers would be regarded as “Operators” for purposes of POPIA.
    • Usage Data: refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
    • Website: refers to Foster-Melliar, accessible from fostermelliar.co.za
    • You: means the individual accessing or using the Service, or the Company, or the legal entity on behalf of which such individual is accessing or using the Service, as applicable.

While using Our Service, We may ask You to provide Us with certain Personal Information that can be used to contact or identify You. Personal Information may include, but is not limited to:

      • First Name and Last Name
      • Phone Number
      • Usage Data

We may also collect your name, language, company, contact number, area information for a better experience with the service.

When you place your order/booking with us, we collect your email in order to send you confirmation of the booking as well as details of the training/exam/learnership and where the training/exam will take place. We also collect your phone number in order to contact you in case these emails bounce back or we need to find out why you not in the training, learnership or have not arrived for your exam.

We also contact the phone number that is provided if we suspect that the cardholder’s credit card information has been compromised, i.e used in a fraudulent way.

We also use our clients’ email addresses in order to notify of the release of updated versions of the training courses, new services or promotional offers (the “marketing material”).  You agree that the Company may send you the marketing material, but you may opt-out or unsubscribe from receiving the marketing material at any stage.

USAGE INFORMATION

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.

USER  RIGHTS

You have the right to access your Personal Information and, if necessary, have it amended or deleted or restricted. You can also ask us to not send marketing material and not to use your Personal Information when carrying our profiling for direct marketing purposes. You can opt-out of receiving email newsletters and other marketing material by following the opt-out instructions provided to you in those emails. Transactional account messages will be unaffected if you opt-out from marketing communications.

RETENTION OF YOUR  PERSONAL INFORMATION

The Company will retain Your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy.
